Welcome to COSMVS. These Terms of Service ("Terms") govern your use of cosmvsjewelry.com (the "Site") and any purchase you make from us. "COSMVS", "we", "us" and "our" refer to RC Vicz LLC. "You" refers to anyone who visits the Site or places an order.
1. Agreement to these Terms
By browsing the Site or placing an order, you agree to these Terms and to the policies they reference: our Privacy Policy, Shipping Policy and Refund Policy. If you do not agree, please do not use the Site.
We may update these Terms from time to time. The "Last updated" date shows when they last changed. The version in force when you place an order applies to that order.
2. Eligibility
You must be of legal age in your country of residence to place an order, or have the consent of a parent or guardian. You agree that the information you give us, including your name, address, email and payment details, is accurate and complete.
3. Our products
COSMVS designs sculptural, minimalist jewelry without stones, made in 925 sterling silver and gold-plated metal. We aim to show every piece as accurately as possible. Colors, finish and scale may still look slightly different depending on your screen and lighting.
Some pieces are finished by hand, so small variations in shape or texture are part of the design and are not defects. Sizes and measurements are listed on each product page. Please check them before ordering.
4. Prices and promotions
Prices are shown in US dollars (USD) unless the Site displays them in your local currency. Converted prices are estimates; your bank or card issuer may apply its own exchange rate or fees.
Prices do not include import duties or local taxes unless the checkout states otherwise (see section 7).
Only one discount code, promotion or store credit can be applied per order. Codes have no cash value, cannot be combined and may expire or be withdrawn at any time.
If a product is listed at an incorrect price because of an error, we may cancel the order and issue a full refund, even after confirmation.
5. Orders
Your order is an offer to buy. A contract is formed only when we send a shipping confirmation. Until then, we may refuse or cancel an order, for example if a piece is out of stock, the price was wrong, or the order looks fraudulent. If we cancel, you receive a full refund to the original payment method.
You may request a change or cancellation within 24 hours of placing your order by writing to hello@cosmvsjewelry.com. After that, the order may already be in production or in transit.
6. Payment
Payments are processed securely by our payment providers at checkout. We never see or store your full card details. By submitting payment, you confirm that you are authorized to use the payment method. Your order is processed only after payment is approved.
7. Shipping, duties and taxes
We ship to the countries listed in our Shipping Policy. Pieces are shipped directly from our partner workshops, so an order with several items may arrive in separate packages. The estimated delivery time is listed in our Shipping Policy. They are estimates, not guarantees.
International orders may be subject to import duties, taxes and customs fees charged by the destination country. Unless the checkout states that these were collected at purchase, they are your responsibility and are paid to the carrier or customs authority on delivery. If you refuse to pay them and the package is returned, shipping and return costs may be deducted from your refund.
Please make sure your shipping address is complete and correct. We are not responsible for packages lost or returned because of an incorrect address. Once a package is marked as delivered by the carrier, the risk of loss passes to you.
8. Lost, late or damaged orders
If your order has not arrived within 15 days after the latest estimated delivery date, contact us and we will open an investigation with the carrier. If the package is confirmed lost, we will send a replacement or a full refund.
If a piece arrives damaged or is not the item you ordered, email us within 7 days of delivery with your order number and photos. We will replace it or refund you at no cost.
9. Returns and refunds
You may return unworn pieces in their original condition and packaging within 14 days of delivery. For hygiene reasons, pierced earrings can only be returned if their hygiene seal is unbroken, unless they arrived defective. Full terms, including how to start a return and who pays return shipping, are in our Refund Policy.
Nothing in these Terms limits any right you have under the consumer law of your country, such as a statutory right to withdraw from an online purchase.
10. Warranty and jewelry care
We offer a 6-month warranty against manufacturing defects, counted from the delivery date. It covers issues such as broken clasps, faulty soldering and plating that peels under normal use.
The warranty does not cover normal wear, scratches, loss, accidental damage, or damage from chemicals, perfume, chlorine, salt water or improper care. Sterling silver naturally tarnishes over time; this can be cleaned and is not a defect. Gold plating is a thin layer and gradually wears with daily use.
Care guidance is provided on each product page and with your order.
11. Intellectual property
All content on the Site belongs to COSMVS or is used under license. This includes the COSMVS name and logo, product names, collection names, photographs, text, graphics and site design. It is protected by copyright, trademark and other laws.
You may view and print pages for your personal, non-commercial use. You may not copy, reproduce, republish, sell or otherwise use any content for commercial purposes without our written permission.
12. Acceptable use
When using the Site, you agree not to:
- Use bots, scrapers or other automated tools to access the Site or collect its content or data.
- Interfere with the Site's security, operation or other users' access.
- Place fraudulent orders or use payment methods you are not authorized to use.
- Buy products for commercial resale, or through a buying or purchasing agent, without our written permission.
- Impersonate another person or provide false information.
- Copy, decompile or reverse engineer any part of the Site.
- Use the Site for any purpose that is unlawful in your country or ours.
We may cancel orders or block access to anyone who breaks these rules.
13. Reviews and submissions
If you post a review, photo or comment, it must reflect your genuine experience with a product you bought, and it must not be false, offensive or infringe anyone's rights. You keep ownership of what you post. You give us a free, worldwide license to display and share it on the Site and our social channels, with credit to your name or handle.
We may remove any submission that breaks these rules. We do not edit reviews to change their meaning, and we do not publish reviews that we have written or paid for. Any ideas or feedback you send us may be used without obligation to you.
14. Privacy
Your personal data is handled as described in our Privacy Policy. Our store runs on Shopify, and your data may be processed in countries other than your own, including the United States and Brazil.
15. Disclaimer
The Site is provided "as is" and "as available". We work to keep information accurate and the Site available, but we do not guarantee that it will be uninterrupted, error-free or free of harmful components. We may correct errors in descriptions, prices or availability at any time.
This disclaimer does not affect the warranty in section 10 or any guarantee you are entitled to under consumer law.
16. Limitation of liability and indemnification
To the fullest extent permitted by law, COSMVS is not liable for indirect, incidental or consequential damages, such as lost profits or data, arising from your use of the Site or our products. Our total liability for any claim related to an order is limited to the amount you paid for that order.
You agree to cover any losses or legal costs we incur because you breached these Terms or violated the rights of a third party.
Nothing in this section limits liability that cannot be limited by law, such as liability for fraud or for personal injury caused by negligence.
17. Governing law and disputes
These Terms are governed by the laws of Brazil. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring a claim in your local courts where that law allows it.
If something goes wrong, please contact us first at hello@cosmvsjewelry.com. Most issues can be solved quickly by email. California residents may also contact the Complaint Assistance Unit of the California Department of Consumer Affairs.
18. Suspension and termination
We may suspend or end your access to the Site, or cancel pending orders, if you breach these Terms or if we reasonably suspect fraud. Sections that by their nature should survive, such as intellectual property, liability and governing law, remain in effect.
19. Electronic communications and general terms
By using the Site or emailing us, you agree to receive communications electronically. Agreements and notices we send by email or post on the Site satisfy any requirement that they be in writing.
These Terms, together with the policies they reference, are the entire agreement between you and COSMVS. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. We are not responsible for delays caused by events beyond our reasonable control, such as carrier disruptions, customs holds or natural disasters.
20. Additional terms for customers in the United Kingdom and the European Union
If you live in the UK or in a country of the European Union or EEA and buy as a consumer, the following rights apply in addition to these Terms. Where anything in these Terms conflicts with them, this section prevails.
Who you are buying from. Your contract is with RC Vicz LLC, 8200 NW 41st Street, 2nd Floor, Doral, FL 33166, United States, hello@cosmvsjewelry.com.
Prices and taxes. For orders shipped to the UK and the EU, the price shown at checkout includes VAT where we collect it at the point of sale. If any duty or tax will be collected on delivery instead, we tell you before you pay. Delivery costs are shown before you place your order.
Right to cancel (14 days). You can cancel your order for any reason within 14 days of the day you, or someone you name, receive the goods. For an order delivered in several parcels, the period runs from the day you receive the last one. You can cancel by:
- using the "Withdraw from contract here" function on our Site;
- emailing hello@cosmvsjewelry.com with a clear statement; or
- sending the model cancellation form below.
You only need to send your notice before the 14 days end. We confirm receipt by email without delay.
Returning the goods. Please send the pieces back within 14 days of telling us you are cancelling. You pay the direct cost of returning them, unless they are faulty or not as described. You may handle a piece as you would in a shop to inspect it, but you may be responsible for any loss in value caused by handling beyond that.
Your refund. We refund all payments received from you, including standard delivery costs, within 14 days of receiving the goods back or of receiving proof that you sent them, whichever is earlier. If you chose a delivery method more expensive than our cheapest standard option, we do not refund the extra cost. Refunds go to your original payment method at no charge to you.
Exception: sealed earrings. The right to cancel does not apply to pierced earrings delivered with a hygiene seal if you have broken that seal, because they cannot be resold for health protection reasons.
Faulty or not-as-described goods. You have legal rights that our 6-month warranty does not replace or limit:
- UK: under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. You can reject faulty goods for a full refund within 30 days of delivery. After that, you can ask for a repair or replacement, or a price reduction or refund if that fails.
- EU/EEA: under EU consumer law you have a legal guarantee of conformity of at least 2 years from delivery. You can ask for repair or replacement, and if that is impossible or fails, a price reduction or refund. National laws may give you more time.
Product safety. Our pieces are sold in line with applicable product safety rules. The manufacturer and, for the EU, our EU responsible person are named on each product page.
Disputes. You can bring a claim in the courts of the country where you live. The European Commission's online dispute resolution platform closed in July 2025 and is no longer available.
Your personal data. You have rights under the EU GDPR and the UK GDPR, including access, correction, deletion and objection. How to exercise them is explained in our Privacy Policy.
